Personal Injury Benefit - FAQ's
Here are some frequently asked questions that may help to answer any queries you have:
- If I receive several of the major injuries, will I receive the individual totals as a cumulative amount?

1. If I receive several of the major injuries, will I receive the individual totals as a cumulative amount?
No, the amount we will pay is not cumulative. We will make only one payment under the Personal Injury Benefit section of your policy to an insured person or their legal representative in respect of any one Accident.
We will pay the following benefits to an insured person or their legal representatives in the event of an accident which occurs during the period of cover whilst travelling as a passenger in, whilst driving or whilst getting into or out of the insured vehicle:

2. Does this benefit affect the Additional Benefits under section 5 that covers Personal Accident?
The Personal Injury Benefits are in addition to any payment we may make under Section 5, personal accident benefit of your policy.

3. Does this benefit cover passengers in the car?
Yes - Personal Injury Benefit does provide up to £30,000 cover for your passengers regardless of which driver is at fault.
In addition, passengers are legally entitled to civil compensation from the at-fault driver – if that happens to be you, don’t worry as Section 1 of your policy, Liability to other people, covers you for all the amounts which you may be legally liable to pay if you have an accident in your car and someone else (i.e. which includes your passengers) is killed or injured.

4. Does the Medical Expenses Benefit cover passengers in the car?
No. The only person who can claim is the driver following an accident which is deemed to be a ‘fault accident’ claim. There is cover for the passengers as part of the claim through the standard policy cover.

5 What if the accident is not my fault, can I still claim the Medical Expenses benefit?
No. This benefit only applies if the policyholder or named drivers are the driver involved in the accident which is deemed to be a ‘fault accident’. You can claim some of these expenses under the standard policy cover. You may also be able to make a claim on the insurance policy of the Third Party driver.

6. When can I claim under the Medical Expenses benefit?
If you have suffered an injury as a result of a road traffic accident for which we are unable to make a recovery of the costs on your behalf.
